Abstract: With special reference to the 1st Optional Protocol of the Covenant on Civil and Political Rights, the Convention Against Torture and the European Convention on Human Rights, examine underlying concepts and gaps in refugee protection. Taking accountrelevant mechanisms and case law which protects from refoulement, the author shows that internationalmechanisms can serve to counter-balance politically expedient decisions ofauthorities and thatprocedures deserve the attention of practitioners. Those concerned with international protection should familiarize themselves with the admissibility criteria and acquire the skills to lodge a petition. |

REPORT ON THE DEFINITION OF MINORITIES
English juridical study that defines minorities and puts the term minorities in a social and ethnical context. At the same time he looks into the connection between minorities and human rights and tries to find out if a minority take up a special position within the state or ought to take up a special position.

Summary: The purpose of the study is twofold. In the first place it should serve to reach a better understanding of the extreme difficulties involved in formulating a universally acceptable and applicable definition of the term. Secondly, it will hopefully also contribute to future attempts to do away with hardships minorities must endure. In this study the following questions were to be addressed: the definition and constituent elements of the term "minority"; To place the term in it's social and ethnic context; to investigate the relationship between minority and human rights; to determine whether a minority has a special place in the State or legal system and if not, whether it should be given one; to discover to what extent minorities or their members are subject to special rights and obligations in our legal system; what would the ideal situation be? |
